Conditions") apply to all orders which you, the customer ("you"
or "your"), place using this website "www.foodhq.co.uk
("Website"), operated by us, FoodHQ ("we" "us" or
"our"). Please read them carefully before placing your order and
print a copy for future reference. The information and products on the site are
directed solely at individuals who access the site from within the United Kingdom.
FoodHQ makes no representation that any product referred to in the site
is appropriate for use, or available, in any other countries. Those who choose
to access this site from other countries are responsible for compliance with
local laws if and to the extent local laws are applicable.
We have taken every care in the preparation and presentation of the content of the site. However we cannot guarantee uninterrupted access to the site and therefore cannot guarantee that the information will always be completely up to date and free of errors. To the extent permitted by applicable law, FoodHQ disclaims all warranties; express or implied, as to the accuracy of the information contained in any of the materials on the site and will accept no liability for any loss or damage arising as a result of problems with access to the site.
Products are invoiced in GBP sterling at the price prevailing at the time you place your order and include VAT where appropriate. Delivery on orders under £40.00 is charged extra. Please refer to our delivery charges for details. Although we try to ensure that all prices on the Website are accurate, errors may occur. If we discover an error in the price of items you have ordered, we will contact you as soon as possible. You will have the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled. Promotions and prices you see in any advertising and marketing material may not apply to the FoodHQ online store, and vice versa. The basis and duration of any promotion or special offer will be clearly stated in the "More Details" page associated with the product.
We use a Secure Payment Provider (SECPAY). This enables us to offer a fully secure automated credit card payment system for all internet transactions. This system means that nobody has access to your card details as they are authorised directly with the bank. This system has been approved by all of the leading banks and the Which? Web Trader Code of Practice. The SECPAY system also allows us to take Credit Card details via the telephone, we have a strict policy that as soon as the card details have been processed, they are destroyed. Any postal orders can of course be paid for by cheque, we prefer not to receive cash unless goods are collected directly from us.
METHODS OF PAYMENT
For orders placed online or by telephone we accept payment only by Credit Card. We accept Visa, Mastercard, Delta and Maestro. For orders placed through the post we also accept cheques.When you place your order, our system automatically asks your card issuer for authorisation for this amount. If we get a valid authorisation, your card issuer will hold this value expecting a charge from us. Receipt of your credit card details and debit of payments does not constitute our acceptance of your order. Please note that we cannot guarantee the security of data when you send us an email. Accordingly please do not send us payment information using email. For details of the security measures we employ please read our Privacy Statement. Unless we are fraudulent or negligent we will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information you provide us when placing an order. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery. Orders can only be delivered to UK addresses. Transactions will show on your statement as payments to FoodHQ .
REFUNDS, RETURNS AND BREAKAGES
It is the policy of FoodHQ to ensure that all goods are supplied to our customers in perfect condition and that every possible precaution is taken to protect the integrity of the product sold. To this end, we are unable to exchange food or beverages, personalised items or items worn on the body that may have come into contact with the person. This policy does not affect your statutory rights. Refunds will only be given for faulty or damaged goods. Please return the item(s) with proof of purchase. COLOURS, SPECIFICATIONS AND DIMENSIONS OF PRODUCTS
We have made every effort to display the colours, specifications and dimensions of items on the Website as accurately as possible. The colours you see will depend on the resolution of your monitor, we cannot guarantee that your monitor's display of any colour will reflect accurately the colour of the item delivered. We may from time to time vary the dimensions, specifications and quantities of items displayed on our Website without prior notice.
The products we supply may have been processed or packed in food premises that also handle seeds or nuts.
AVAILABILITY AND ITEMS AND SUBSTITUTION
We accept orders for items subject to availability. If for any reason the items you ordered are no longer available, we will contact you using the contact details you supplied when placing your order and either offer you an alternative item of equivalent quality and price if this is possible; wait until we can supply the original goods, finally you can cancel the item from your order and give you a full refund in respect of that item.
You, the consumer have the right to cancel your order within 7 working days of the day after the goods are received. We will in all circumstances refund the cost of purchase within 30 days of cancellation, should you return the goods the cost of postage will also be refunded.
If we are unable to contact you or do not receive a response from you, we will process any remaining items on your order and refund you for the items we were unable to supply.
We hope you will never feel the need to complain, but if you do we will acknowledge the complaint within 3 working days. Also keeping you updated with progress on resolving it.
PRIVACY AND COMMUNICATIONS
When you place your order, we collect certain personal and transactional information (e.g. name, address, email address, credit/debit card details). Changes which we are required to make by law could apply to orders which you have already made. If any of the terms and conditions forming the contract between us are deemed invalid, void or unenforceable for any reason, it will be deemed severable and not affect the validity and enforceability of the remaining terms and conditions.
